Policy for Refusing to Certify a Student Loan Application
Legislative Authority:
The HEA Technical Amendments of 1991 state that "an eligible institution may refuse to certify a statement which permits a student to receive a loan (under the FFEL programs) or to certify a loan amount that is less than the student's determination of need (under FM) if the reason for such action is documented and provided in written form to each student so affected." This authority was reiterated in the Reauthorization of the Higher Education Act signed by President Clinton in October, 1998.
MUOT Policy:
The Student Financial Aid (SFA) Office at the University of Toledo, Health Science Campus, will refuse to certify a Title IV loan application for a student if any of the following conditions applies:
- The SFA Office has reason to believe that the student does not plan to enroll for some/any of the terms included in the student’s loan period,
- The ability of the student to continue in his/her program, based on academic performance, is questionnable,
- The student’s borrowing patterns and amounts indicate borrowing for reasons other than allowable educational expenditures,
- Other documented reason supporting the reduction or denial of a student’s loan application.
Procedure:
The SFA Office, upon determining that the student meets one of the above conditions, will draft a letter to the student informing him/her that his/her loan application will either not be certified or certified for a lesser amount than requested with an explanation of the reason(s). The letter will also explain the appeal process and the timeframe for filing an appeal.
Appeal Procedure:
A student may appeal the decision to refuse to certify his/her loan application by sending a letter of appeal to the Vice Provost for Student Affairs, Health Science Campus. The respective individual will review the appeal within ten (10) days of receiving the appeal and will notify the student of his/her decision within 15 days of receiving the appeal. The decision of the Vice Provost for Student Affairs, Health Science Campus, is final.
